CHARLOTTE, N.C. -- A mistrial was declared in the trial of three men charged in an alleged June 17 assault of former NASCAR driver Mike Wallace, his adult daughter and son-in-law.Two potential witnesses were in the courtroom for part of the opening testimony Tuesday -- violating the sequestration order in the case -- and North Carolina District Court Judge Ronald Chapman determined their testimony could be influenced by what they saw.All I can hope is we will have an honest day in court, Wallace said afterward. I dont understand it. ... I sincerely dont understand what a mistrial is or why a mistrial was caused.Wallace said he was told by prosecutors that they would retry the case in the future.The bench trial was expected to last at least two more days when the issue of the violations of the sequester were brought up by the district attorneys office to defense attorneys after the conclusion of court Tuesday.The prosecution had not completed its case and had both of the witnesses on its potential witness list while one of the witnesses also was on the potential defense witness list.Both witnesses, one a friend of Wallace who went with the Wallace family to the Rascal Flatts concert where the fight occurred in the parking lot following the concert, have a Nov. 7 hearing for contempt of court. The judge determined they had heard his order at the start of the case that witnesses could not sit in the courtroom and could not talk among themselves about the case or view any social media or traditional media reports on the case.The Wallace friend, Robert Wood, had been identified in testimony having been wearing boots that night. One of the issues presented by the defense during the opening day of testimony was that Wallace was kicked in the head by someone wearing a boot and whether any of the defendants were wearing boots that night.The fact someone appears to have directly violated an order from the judge is too much for me to let pass, Chapman said when declaring the mistrial.The defendants -- Paul Lucas, Nathan Lucas and Randolph Mangum -- could face another trial, depending on whether prosecutors determine to retry the case. Paul Lucas faces four misdemeanor assault charges while Nathan Lucas and Mangum face two apiece.The 57-year-old Wallace said he still has black floaters in his right eye from getting hit in the face as well as a broken tooth that he still needs to have replaced and lacerations in his mouth. His daughter, Lindsey Van Wingerden, suffered a broken wrist and black eye. .J. -- Josh Cribbs was in the Pro Bowl in February and out of a job six months later. . "He was just always competing hard, and just loved the game." Starting when Nathan was seven, the MacKinnons billeted Mooseheads players Frederick Cabana, who went on to play professional hockey in Germany. "He was with us for two or three years and I got to know him pretty well," said Nathan MacKinnon. "Being a kid I idolized him, and always wanted to get to this moment." MacKinnons mother Kathy said he showed a precocious knack for sports, displaying remarkable hand-eye co-ordination and agility from an early age. "He walked early, and always had a stick or basketball bat or golf club or hockey stick the minute he could walk," said Kathy Mackinnon. While he had a clear love for hockey, Kathy said he also showed a talent for canoe racing, basketball, soccer and tennis. "I knew there was no question hed play sports," she said. "We just didnt know what sport it would be." Graham MacKinnon said the whole family is trying hard to stay grounded in the face of a deluge of wealth and fame with the NHL draft quickly approaching. "We live in the moment and take it day by day you know, honestly, and he does the same thing" he said. "You never want to get too far ahead of yourself, and thats what we try to preach to him too." As for the comparisons to Crosby, Graham MacKinnon said these are pretty superficial. "Theyre two different players from the same area, thats just about it," he said. ' ' '
